These Terms and Conditions form part of our agreement, between you, the “User” or “Client”, and me, the “Coach”, when you use any of my information, products, programs, courses, memberships or services in-person and/or online. By using any information from this website and purchasing products, programs, courses, memberships, and services, in-person and/or online, Users and Clients are automatically agreeing to accept these Terms and Conditions.

Please pay special attention to the provisions related to refunds, cancellations, and expires.

COACH’S OBLIGATIONS

  • As a Client’s Coach, I will use my skills and knowledge to design a safe program that will take into account my Client’s lifestyle, personal goals, fitness levels, and medical history.
  • I will provide the coaching, supervision, advice, and support that a Client will need to achieve their goals.
  • A Client understands that the results of any health and fitness program cannot be guaranteed.
  • A Client’s progress depends on their effort and co-operation in and outside of the sessions.
  • In particular, a Client will acknowledge that individual results may vary and no particular result is guaranteed by their Coach.
  • All Client information will be kept strictly private and confidential. Please read my Privacy Policy.

CLIENT’S OBLIGATIONS

  • It is understood between the Client and the Coach that we both must commit to the Client’s training program 100% in order for the Client to achieve results.
  • A Client is required to arrive on time for each session so that complete coaching is achieved on each visit.
  • A Client is required to wear appropriate clothing and footwear (under certain conditions barefoot is acceptable, if preferred).
  • A Client is required to complete a waiver and medical questionnaire before undertaking their first session.
  • The Coach may require a letter of ‘medical clearance’ from the Client’s doctor depending on the results of the medical questionnaire (please be aware that some doctors charge for providing this letter).
  • A Client understands and agrees that it is their responsibility to inform the Coach of any conditions or changes to their health, now and ongoing, which might affect their ability to exercise safely and with minimal risk of injury.
  • If the Coach requires further medical information from a practitioner, the Client must provide such details.
  • A Client understands that there are inherent risks in participating in a program of strenuous exercise.
  • If a Client sustains or claims to sustain an injury while participating in training sessions, the Client acknowledges that the Coach is not responsible, except where the injury was caused by the Coach’s gross negligence or intentional act.
  • The Coach cannot be held liable in any way for undeclared or unknown medical conditions.
  • The Client is responsible for keeping all their contact information and preferences up-to-date with the Coach.

CANCELLATIONS | REFUNDS | EXPIRY DATES

  • Personal coaching services are 100% non-refundable.  No exceptions! 
  • Monthly sessions are set up and prepaid one month in advance so the client can see the plan, ask questions, and prepare for the training ahead of time.
  • A client may cancel their coaching services at any time however because plans are prepared one month in advance, no refund is given for the remainder of that month. Clients have the option to finish out their coaching for the remainder of the term.
  • Clients should arrive 5 minutes before the start of their session (live or online) to ensure they get the full session. The clock starts and ends at the time the session was booked. If a Client is late the session will not be extended. If the Coach is late additional time will be added to the session or to subsequent sessions.
  • 24 HOURS NOTICE IS REQUIRED TO BOOK OR CANCEL A SESSION!  24 hours notice is required to book a session with the Coach. The Coach needs time to organize and prepare for upcoming appointments. If a session has to be cancelled, and more than 24 hours notice is given, the Client will need to rebook that session within the next two weeks of the cancelled session. If the session is not rescheduled before their coaching is completed, the Client will lose that session and no credit or refund will be given. It is the Client’s responsibility to ensure they rebook their cancelled sessions.
  • Clients who cancel an appointment within 24 hours of their session WILL LOSE THAT SESSION FROM THEIR PACKAGE. No exceptions! All Clients receive a text and/or email notification of upcoming appointments 48 hours in advance, giving them ample time to cancel or reschedule before the 24-hour limit arrives. When a Client cancels under 24 hours notice, the Coach loses the opportunity to book another Client in that same spot = loss of income.
  • Coaching packages can be paused for unforeseen circumstances, such as a medical condition or loss of a job, but NOT pertaining to vacation, holidays, etc. This decision is done case by case and it is best to speak to the Coach about the situation first.
  • If the Coach has to temporarily stop coaching services for a period of time, all Clients will receive a time extension on their package equal to the number of days the Coach is unavailable.

NON-TRANSFERABLE

A Client cannot transfer their unused portion of their coaching packages to another individual.

ONLINE COACHING TIME LIMITS

Each personal coaching package comes with a certain number of coaching minutes and materials per month.  The Coach tracks coaching minutes per Client and remains within the coaching minutes. If a Client needs more of the Coach’s time, the Client will have the ability to upgrade or buy extra coaching minutes as needed.

COACHING BOUNDARIES

I am a solopreneur and operate a very full-time and demanding fitness business. I can’t even begin to list the many hats I wear. Because of this, I greatly limit the number of personal clients I will take on at any given time. I do this so I can provide each and every one of them a high-quality service and give them the attention they deserve.

However, I am only one person and I have to set boundaries or else I will go insane and trust me, you do not want an insane person coaching you. Ha!

Please respect the coaching time limits above and avoid sending me numerous emails and/or text messages. I have had clients in the past message about all sorts of things that they could have very well figured out on their own with a tiny bit of effort. Some of them have crossed boundaries as well and started to message me about things that had nothing to do with coaching.

This greatly takes my attention away from other things that are important, including time with my family and for myself. So here are the rules to set some boundaries:

  • One email per week (a few more when starting and until you feel you have found your groove)
  • Only text me when you really need to know something and it can’t wait
  • Do not text me outside my work hours (9 am – 7 pm) unless it’s emergency

GROUP PROGRAMS & WORKSHOPS

  • There will be no refunds for program or workshop withdrawal under any circumstances unless requested 7 days prior to the starting date of the program or workshop.
  • If a request for withdrawal is made within 7 days of the program or workshop start date, a 25% admin fee is withheld to cover administration costs.
  • Programs or workshops without sufficient enrollment may be cancelled at any time; an option of a credit or refund will be given.
  • There will be no makeup classes, credits, or refunds for personal absences, vacations, inclement weather, or missed classes or workshops by the participant for any reason.
  • Program or workshop enrollment cannot be transferred to another individual.
  • In the case of cancellation due to bad weather, an alternate date will be set for a class or workshop. If an alternate date cannot be set, an option of a refund or credit will be given.
  • Participants may be filmed or pictures taken for marketing purposes. Participation in a session means participants consent to photography, filming and sound recording which may include you as a Client and its use in commercial distribution without payment or copyright.
  • The Client is responsible for keeping all their contact information and preferences up-to-date with the Coach.
  • It is the Client’s responsibility to be aware of individual class and program dates, times, and locations.

When you purchase a membership, you agree to the Terms and Conditions and authorize your payment method to be saved and charged on a recurring basis until you cancel, which you can do at any time. You understand how your subscription works and how to cancel.

Subscriptions are charged to your credit card on a monthly schedule. The first payment will be applied immediately when you join. Monthly payments will occur on the same date each month that you made your initial payment. For example, if you sign up on the 19th of any given month, your payment will be charged on the 19th of each month.

Eligible Reasons for Refund Requests
  • You have purchased the subscription, and after using and interacting with the program, have found that it does not work for you.
  • You have an issue that I am unable to resolve which makes the program unusable. I may ask you questions regarding the nature of your refund request so I can improve the membership program in the future.
  • You have contacted Tammy and allowed her to attempt to resolve your issue(s) or have explained why the membership will not work for you.

Refunds will be offered at my sole discretion. By purchasing this membership from my site, you agree to this refund policy and relinquish any rights to subject it to any questions, judgment or legal actions. UPDATE JUNE 1, 2021: Outdoor programs are available but my studio remains closed to the public.

To ensure the safety of my participants, I am following an approach in accordance with public health guidance from Alberta Health.

  • All workers, volunteers and patrons will be screened for COVID-19 symptoms.
  • I will prohibit entry to any worker, volunteer or patron who is sick or symptomatic.
  • All staff will be trained on hygiene in order to prevent the spread of infection.
  • All workers, volunteers and patrons will use their own personal equipment.
  • Items should not be shared unless done so by members of the same household.
  • All workers, volunteers and patrons will need to carry and use their own hand sanitizer containing at least 60% alcohol content.
  • All workers, volunteers and patrons should maintain physical distancing of at least 2 metres from others, unless they are from the same household.
  • Group services will be capped at 10 participants and be able to maintain physical distancing.
  • Cover your mouth if you cough or sneeze and then immediately sanitize your hands.
  • Masks are optional – all activities are outside with 2 meters distancing and activities are high intensity.
  • All registration and payment must be done online.
  • Public washrooms will not be available.
